Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before using the David Kingston College website and services.

Effective date: 11 August 2025

Important: These Terms are drafted to align with UK consumer and e-commerce laws, including the Consumer Contracts Regulations 2013, the Consumer Rights Act 2015, the Electronic Commerce Regulations 2002, PECR (cookies), and UK GDPR/Data Protection Act 2018 (as amended). They do not constitute legal advice.

1) Who we are and how to contact us

Trading name. "David Kingston College" ("DKC", "we", "us") is a trading name of David Kingston Holding B.V., a private limited liability company (besloten vennootschap) incorporated in the Netherlands.

2) Scope of these Terms

These Terms govern your access to and use of our website dkcollege.co.uk, its sub-domains, and any online services, content, learning platforms or applications made available through it (collectively, the Services).

If you enrol on a Course (including programmes, modules, short courses, workshops, live online events and on-demand digital content), these Terms apply to the distance contract you enter into with us when you purchase. Additional documents may also apply, such as the Student Handbook, Code of Conduct, Assessment Regulations, Complaints & Appeals Policy, Privacy Notice, and Cookie Policy (together, the Policies). In case of conflict, the documents apply in this order: (1) Course-specific terms, (2) these Terms, (3) the Policies.

Business vs consumer. Some sections apply differently if you are a consumer or a business customer. We highlight differences where relevant.


3) Eligibility and your account

  • You must be at least 16 years old to use the Services. Under 18s confirm parental/guardian permission (we may require written consent).
  • Certain features (e.g., enrolment, payment, the learning portal) require an Account. You agree to provide accurate information, keep credentials secure, promptly update changes, and accept responsibility for all activity under your Account.
  • We may refuse, suspend, or close Accounts that breach these Terms or our Policies.

4) Information we must give you by law (pre-contract information)

Before you purchase, we will provide clear information about: (a) the Course, content, duration and any entry requirements; (b) total price inclusive of taxes/fees; (c) how payment works; (d) start date and delivery method; (e) your right to cancel (including the model form in Annex A); (f) our identity and contact details; and (g) complaint handling and after-sales support.


5) How the contract is formed

  1. Order: You place an order by completing checkout or an enrolment form.
  2. Acknowledgement: We will acknowledge receipt (not acceptance).
  3. Acceptance: A contract forms when we accept your order (e.g., confirmation email or access granted).
  4. If we cannot accept: We will inform you and refund any payment taken (e.g., if a Course is full, withdrawn, mispriced, or requirements are unmet).

6) Prices, taxes and payment

  • Prices are in GBP and include VAT where applicable unless stated otherwise.
  • Prices may change, but changes do not affect orders already accepted.
  • You authorise us (and our payment providers) to take payment using your chosen method.
  • Instalments: If we agree an instalment plan, you must pay on the agreed dates. Late/missed instalments may lead to suspended access, withholding certificates, and/or referral to collections.
  • Third-party fees: Your bank/card provider may charge additional fees or exchange costs.
  • Errors: If there is an obvious pricing error, we may cancel and refund even after acceptance.

7) Delivery of Courses and digital content

  • Digital content & services: Courses may include live sessions, recordings, downloads, or access to a learning platform. Access will be provided within a reasonable time after acceptance or on the advertised start date.
  • Technical requirements: Ensure your devices, software, bandwidth, and permissions (e.g., corporate firewalls) are suitable. Minimum specifications will be stated where relevant.
  • Service availability: We aim for high availability but do not guarantee uninterrupted access. Planned maintenance or external events may affect availability (see Force Majeure).

8) Your legal right to cancel (consumers)

  • Cooling-off period: If you buy online or at a distance as a consumer, you have 14 days from the day of contract to cancel without giving a reason. See Annex A for the model cancellation form.
  • Services that start within 14 days: If you ask us to begin the Course during the 14-day period, you agree to pay a proportionate amount for services provided up to the time you cancel.
  • Digital content (instant access): If the Course includes digital content supplied immediately and you consent to immediate supply and acknowledge you will lose the right to cancel once supply begins, you will not have a right to cancel after access is granted.
  • How to cancel: Email admin@dkcollege.co.uk or legal@dkcollege.co.uk, or write to our correspondence address, clearly stating your decision. You may (but do not have to) use the form in Annex A.
  • Refunds: We will refund the price paid (less any proportionate amount under 8.2) using your original payment method within 14 days of receiving your cancellation notice, or (if later) from the day we can verify any return obligations have been met.

9) Course changes, cancellations and minimum numbers

  • We may make non-material changes to content, instructors, dates or delivery method.
  • If we make a material change or cancel a Course, we will offer a transfer to an alternative or a full refund of fees paid.
  • Our liability for cancellations is limited to a refund of fees paid for the affected Course (see Liability).

10) Conduct, academic integrity and fair use

  • Comply with our Code of Conduct and Acceptable Use Policy.
  • Academic integrity: No plagiarism, cheating, collusion, or impersonation. Breaches may result in disciplinary action, up to removal without refund.
  • Fair use: Course materials are for your personal, non-commercial use. Do not share or redistribute unless explicitly permitted.

11) Intellectual property

  • We (or our licensors) own all IP rights in the Services and Course materials.
  • We grant you a limited, revocable, non-transferable, non-exclusive licence to use Course materials for personal study during and after enrolment, subject to these Terms.
  • You must not copy, adapt, translate, publish, distribute, or create derivative works without permission, except where permitted by law.

12) User-generated content

  • You retain ownership of content you submit (e.g., forum posts, assignments, reviews).
  • You grant us a worldwide, royalty-free, transferable, sub-licensable licence to use, reproduce, adapt, publish and display such content to operate and improve the Services.
  • You warrant your content is lawful, accurate and non-infringing. We may remove content that breaches these Terms.

13) Data protection and cookies

  • We process personal data in accordance with UK GDPR and the Data Protection Act 2018 (as amended). See our Privacy Notice for lawful bases, retention, international transfers and your rights.
  • Our website uses cookies and similar technologies governed by PECR. See our Cookie Policy for cookie types and preference management.

14) Liability

  • Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any liability that cannot legally be excluded or limited.
  • Consumers: We are responsible for foreseeable loss or damage caused by breach or failure to use reasonable care and skill. We are not responsible for loss that is not foreseeable or for business losses.
  • Business customers: To the fullest extent permitted by law, we exclude implied terms, warranties and conditions; and our total liability shall not exceed the total fees paid by you for the Course giving rise to the claim in the 12 months preceding the claim.

15) Events outside our control (Force Majeure)

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including strikes, lock-outs, industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat, war, fire, explosion, storm, flood, earthquake, epidemic, pandemic, or failure of telecommunications networks. We will use reasonable endeavours to minimise disruption and resume performance as soon as practicable.


16) Complaints and dispute resolution

  • Complaints: Please contact admin@dkcollege.co.uk. We aim to acknowledge within 5 working days and respond substantively within 20 working days. See our Complaints & Appeals Policy.
  • ADR: If we cannot resolve a consumer complaint, we will engage with an independent ADR provider (e.g., CEDR) where applicable.
  • Court: These Terms are governed by the laws of England and Wales. Courts of England and Wales have jurisdiction; consumers elsewhere in the UK/EU may bring claims in local courts.

17) Third-party services and links

The Services may contain links to third-party websites, platforms or tools. We are not responsible for their content or practices. Your use of third-party services may be subject to their terms and privacy policies.


18) Changes to these Terms

We may update these Terms to reflect legal, technical or business changes. We will post updated Terms with a new Effective date and, for material changes, provide reasonable notice (e.g., email or site notice). Continued use after changes take effect constitutes acceptance.


19) Assignment, severability, waiver

  • We may assign or transfer our rights and obligations under these Terms. You may not assign without our prior written consent.
  • If any provision is unlawful or unenforceable, the remaining provisions remain in effect.
  • No failure or delay to enforce a provision is a waiver of any rights.

Annex B – Summary of key consumer rights (non-exhaustive)

  • Cooling-off (distance contracts): 14 days from contract. If service starts within that period at your request, you may be charged proportionally. If you consent to immediate supply of digital content and acknowledge loss of cancellation right, the right is lost once supply begins.
  • Services – reasonable care and skill: If we fail to use reasonable care and skill, you may be entitled to repeat performance or a price reduction.
  • Digital content – quality: If digital content we supply is faulty and damages your device or other content, you may be entitled to repair, replacement or compensation.
  • This Annex is for convenience only and does not replace the legislation or your statutory rights.
